Terms and Conditions

Binding Arbitration Notice

You agree that any disputes between you and imaxweightloss LLC, including our agents, contractors, employees, officers, shareholders, and any affiliated individuals or groups, will be resolved through binding, individual arbitration. This includes disputes related to these terms and conditions and/or the Service. By agreeing to these terms and conditions, you waive your rights to a jury trial and to participate in a class-action lawsuit or class-wide arbitration.

Consent to Telehealth

Telehealth is the remote delivery of healthcare services using electronic communications. While Telehealth has benefits, it is not a substitute for in-person medical care in all cases or conditions. By using the Service, you acknowledge and accept the potential risks associated with Telehealth. If you do not accept these risks, you should seek in-person care. Imaxweightloss LLC is a third-party beneficiary of the Medical Consent form, which includes consent to telehealth treatment, and has the right to enforce it against you.

Use By Minors

The Service is intended for use by individuals who are eighteen (18) years of age or older. Individuals under the age of eighteen (18) are prohibited from using any part of the Service and/or the Platform, except to read these Terms and Conditions.

Your Relationship with Us

Through the Service, we offer products and services provided by us and third-party providers, including medical and nursing care, pharmacies, diagnostics laboratories, and other vendors.

We provide prescription fulfillment services through approved Pharmacies. We also connect you with independent third-party providers and/or medical groups, such as Paula Bilica D.O. By accepting these Terms and Conditions, you acknowledge that any services or products received from these individuals or groups are bound by this Agreement, and they are third-party beneficiaries of this Agreement.

No Medical-Relationship

Imaxweightloss LLC does not control or interfere with the practice of medicine, nursing, or any other healthcare services provided by the providers. Each provider is solely responsible for managing the medical care and treatments they provide to you. By accepting this Agreement, you understand and agree that imaxweightloss LLC is not acting as a healthcare provider, and you are not entering into a patient-provider relationship with us. However, you may enter into a patient-provider relationship or other such relationship with one or more Providers.

No Pharmacy-Relationship

Imaxweightloss LLC is not a pharmacy and does not control or interfere with any pharmacy services. By accepting this Agreement, you understand and agree that you may enter into a relationship with a pharmacy, pharmacist, or pharmacy group. You authorize these entities to access your prescription records through a Controlled Substances Prescription Management Program (CSPMP) or any other program required by law or at the discretion of the Pharmacy.

Consent to the Use of Messaging

By accepting this Agreement, you understand and agree that imaxweightloss LLC, along with third-party Providers and Pharmacies, may receive and respond to messages regarding your treatment through email, text messages (SMS/MMS), phone calls, and voicemails (collectively, "Communications"). You acknowledge that imaxweightloss LLC and its affiliates are not responsible for the contents or security of these means of communication. These Communications may contain important information about your health and treatment. You are solely responsible for receiving and reading these messages and agree to hold imaxweightloss LLC and its employees, officers, or affiliated entities (providers, pharmacies, etc.) harmless regarding the receipt and reading of these Communications. Some Communications may be unrelated to your treatment, such as marketing and advertising Communications.

Consent to Pay for Services

Imaxweightloss LLC and its subsidiaries are not currently enrolled with or participating in any state, local, or federal healthcare and/or health insurance programs, including Medicare and Medicaid. By engaging with imaxweightloss LLC and using the Service, you are choosing to obtain services solely on a cash basis. You are solely responsible for paying the costs associated with the Service.
